DUPLICATION SERVICES AND RATES

TERMS AND CONDITIONS

Payment - Payment is due in full upon final project approval. A 50% deposit is required at submission of project materials. We do not accept personal checks. Payment can be made by cash or mail via money order or company check (subject to 10-day clearing delay), or on-line on our website through PayPal. There is a $35 per hour set up fee for preparation of disc printing if art is not set up according to specifications (call for specs). Balance payment us due upon delivery - no product will be delivered without payment in full. Any orders canceled once the job has begun will incur a minimum $50 cancellation fee plus any costs incurred by Xanthi Music. All custom made products (such as but not limited to mockups, hard copy proofs, CD packages, cassette packages, all print, graphic design, are non-refundable.

Indemnification. Client warrants that he/she is the sole author of the product to be duplicated, and the sole owner of all the rights being granted to Xanthi Music herein for the duplication of this product; and that Client has secured the services of Xanthi Music only for the purposes of duplication of product herein. Client also warrants that he/she has the power to enter into this agreement; that, except for the material required by any and all applicable permissions and licenses. Obtaining and securing any and all necessary permissions, licenses, etc., for the use of existing copyrighted material, in whole or in part, is strictly the responsibility of the Client and that Xanthi Music shall be indemnified from any such requirement and liability resulting from the lack of same. Client does not infringe upon any copyrights of any third party and holds Xanthi Music free from any liabilities associated with same. In the event of any such claim, action or proceeding based upon an alleged violation of any of these warranties, or rights of any third party, Xanthi Music shall be indemnified from claim. Client shall unconditionally hold harmless and indemnify Xanthi Music, including attorney's fees, expert witness fees, costs and expenses, etc., arising from any claim associated with the services requested regarding the product herein. These warranties and indemnities shall survive the termination of this agreement, beyond the completion of services rendered herein. This agreement shall be in accordance with all applicable laws of the State of New Jersey.

Production Samples. Occasionally Xanthi Music would like to use left over inserts, CDs and cassettes as promotional samples for potential new clients to see. These are not for resale, just promotion purposes only and possession of samples remains with Xanthi Music. Turn-Around Time: All turn-around times are estimated and are based on our average production time once proofs have been approved. You will be notified by email upon receipt of your order, then proofs provided in approximately 48 hours upon receipt of your order. THen we will email you .PDF proofs for your approval. Turn-around times are not guaranteed. Estimated turn-around time does not include shipping time. We cannot begin your project until we have a signed approval form and deposit. Xanthi Music will not be responsible for any delays beyond our control and you will hold Xanthi Music harmless against any legal actions that may arise due to but not limited to any financial losses due to any such delays.

Client warrants and accepts the terms and conditions herein. Each order must be accompanied by a CD master, unless other arrangements are made. However, we recommend that you make and keep a backup copy. Please print this form and send it in with your order request. In addition, orders WILL NOT be processed without this form AND the required deposit or PayPal payment.

All duplication includes inkjet printing on CDR disc with art provided by Client.

Advisement: DO NOT TOUCH PRINTED DISC SURFACE: Care must be observed when handling inkjet printed discs - store in a cool, dry place; keep away from moisture; avaoid touched printed surface.
